1. Acceptance of Terms
By accessing or using the website, services, or products of Xpress Computer Solutions ("Company", "we", "us", or "our"), you agree to be bound by these Terms and Conditions. If you do not agree to all of these terms, do not use our website or services.
2. Services
Xpress Computer Solutions provides computer repair, IT support, custom builds, hardware sales, and related services. We reserve the right to refuse service to anyone for any lawful reason. We make reasonable efforts to display product images and descriptions accurately, but we do not guarantee that colors, images, or descriptions are exact.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use our services. By using our services you represent and warrant that you have the legal capacity to enter into these Terms.
4. Orders, Estimates, and Authorization
- Estimates provided for repairs or services are valid for the period stated on the estimate or for 30 days if no period is stated.
- By authorizing service you grant us permission to perform the work described in the estimate or service order.
- Additional work beyond the original authorization will require your approval before we proceed, except where immediate action is necessary to prevent further damage.
5. Payment and Billing
- Payment is due upon completion of service or at the time of purchase unless otherwise agreed in writing.
- We accept major credit cards, cash, and financing through third party providers such as Affirm. Financing is subject to the terms and approval of the financing provider.
- Unpaid invoices that are more than 30 days past due may be subject to late fees, collection costs, and retention of hardware until payment is received.
- We may require a deposit for parts or custom builds. Deposits are nonrefundable except as required by law.
6. Pricing and Taxes
Prices listed on the website or in estimates are subject to change without notice. Applicable sales tax, shipping, handling, and other fees will be added where required by law.
7. Warranty and Returns
- Our limited warranty, if any, is set forth separately and governs repair parts and labor. Warranty terms vary by service and part. Refer to our warranty policy for details.
- Returns of retail products are subject to our return policy. Opened software, custom builds, and special order items may not be returnable.
8. Customer Data and Backup
- You are responsible for backing up all data before submitting a device for service. We are not responsible for data loss except as required by law.
- If you request data backup or recovery services, we will make a best effort to recover data but cannot guarantee success for failing or damaged drives.
9. Limitation of Liability
- To the fullest extent permitted by law, Xpress Computer Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising out of or related to our services or products.
- Our total aggregate liability for any claim arising out of or relating to these Terms or the services provided will not exceed the amount you paid for the specific service or product that gave rise to the claim.
- The limitations in this section do not apply to liability resulting from proven fraud, willful misconduct, or gross negligence.
10. Indemnification
You agree to indemnify, defend, and hold harmless Xpress Computer Solutions and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, and expenses, including reasonable attorneys' fees, arising from your breach of these Terms, your negligence, or your violation of any law or the rights of a third party.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Xpress Computer Solutions or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without our prior written permission.
12. Third-Party Services and Links
We may provide links to third-party websites or services for your convenience. We do not control and are not responsible for the content, privacy practices, or terms of those third parties. Use of third-party services is at your own risk.
13. Termination
We may suspend or terminate your access to our services at any time for conduct that we believe violates these Terms or is harmful to other users, our business, or third parties. Termination does not relieve you of obligations incurred prior to termination.
14. Dispute Resolution
- Small claims. You may pursue claims in small claims court where permitted by law.
- Other disputes. Except where prohibited by law, disputes not resolved informally may be resolved in the state or federal courts located in Tulsa County, Oklahoma. You and Xpress Computer Solutions each submit to the personal jurisdiction of those courts for disputes arising under these Terms.
- This section does not prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.
15. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using our services you consent to our collection and use of personal information as set forth in that policy.
16. Changes to Terms
We may update these Terms from time to time. We will post the revised Terms on our website and indicate the effective date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
17. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
18. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19. Entire Agreement
These Terms, together with any policies referenced herein and any written agreements between you and Xpress Computer Solutions, constitute the entire agreement between you and Xpress Computer Solutions regarding the subject matter.
Governing Law
These Terms are governed by the laws of the State of Oklahoma without regard to conflict of law principles. Any dispute not subject to mandatory small claims procedures or other statutory remedies shall be brought in the state or federal courts located in Tulsa County, Oklahoma.

3. Payment Processing and Financing

We do not store full payment card numbers on our servers unless you expressly authorize us to do so for recurring billing. - Scanning, probing, or testing the vulnerability of any system without prior written permission.
- Interfering with, disrupting, degrading, or denying service to other users or systems.
c. Hacking, malware, and exploitation
- Developing, distributing, or using malware, ransomware, viruses, worms, trojans, or other harmful code.
- Hosting, distributing, or linking to exploit code or tools designed to defeat security controls.
d. Automated and bulk activity
- Systematically retrieving, scraping, harvesting, or copying data to build a database, feed, or dataset without prior written permission.
- Using bots, spiders, scrapers, crawlers, or other automated means to access or interact with the Services in a manner that imposes an undue load on our systems.
e. Spam and unsolicited messaging
- Sending bulk, unsolicited, deceptive, or harassing messages, including spam, phishing, spoofing, or other forms of unsolicited commercial communication.
f. Abuse of resources
- Using the Services for cryptocurrency mining, distributed computing, or other resource intensive tasks not expressly permitted by Xpress Computer Solutions.
- Running processes that consume excessive CPU, memory, disk, or network resources in a way that harms other customers.
g. Fraud, deception, and impersonation
- Misrepresenting your identity or affiliation, impersonating another person or organization, or creating false accounts.
- Using the Services to trick, defraud, or mislead Xpress Computer Solutions or other users.
h. Intellectual property and content violations
- Uploading, hosting, or distributing content that infringes copyrights, trademarks, trade secrets, or other intellectual property rights.
- Using the Services to facilitate piracy or unauthorized distribution of copyrighted works.
i. Privacy and data misuse
- Collecting, storing, or sharing personal data in violation of applicable law or without proper consent.
- Using the Services to stalk, harass, or invade the privacy of others.
j. Circumvention and evasion
- Attempting to bypass usage limits, rate limits, access controls, or security measures.
- Using proxies, VPNs, or other methods to evade enforcement or to conceal malicious activity.
k. Commercial misuse and resale
- Reselling, sublicensing, or repackaging the Services without prior written authorization.
- Using the Services to provide competing services to Xpress Computer Solutions customers without a written agreement.
4. Permitted Activity Subject to Limits
Permitted uses remain subject to reasonable limits and to our right to suspend or terminate activity that harms the Services or other users. Permission from Xpress Computer Solutions is required for any activity that would otherwise be prohibited by this AUP.
5. Enforcement and Remedies
If we reasonably believe you have violated this AUP, we may take any action we deem appropriate, including:
- Issuing warnings.
- Temporarily suspending or permanently terminating access to the Services.
- Throttling, blocking, or filtering traffic that violates this policy.
- Removing or disabling access to content that violates this policy.
- Pursuing civil remedies and cooperating with law enforcement, including disclosing account and usage information when required by law or to protect our rights.
We will make reasonable efforts to notify account holders before suspension or termination when feasible. We are not liable for damages resulting from enforcement actions taken in good faith.
6. Reporting Abuse

7. Appeals
If your access is suspended or terminated and you believe the action was taken in error, contact support@xpresscomputersolutions.com with a clear explanation and any supporting evidence. We will review appeals in a reasonable time frame.
8. Cooperation with Law Enforcement
We may preserve and disclose account and usage information to law enforcement or other third parties when required by law or when we believe disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of others.
9. Limitation of Liability
To the maximum extent permitted by law, Xpress Computer Solutions is not liable for any indirect, incidental, special, punitive, or consequential damages arising from enforcement of this AUP or from your use of the Services. Nothing in this AUP limits liability for fraud, willful misconduct, or gross negligence.

Our Quality Guarantee
We stand behind our service with a comprehensive 1-year limited warranty on all repairs.
1. Coverage
This limited warranty covers defects in materials and workmanship in the specific parts and labor provided by Xpress Computer Solutions for a period of one (1) year from the date the service is completed. Coverage applies only to the parts replaced and the labor performed by Xpress Computer Solutions and does not extend to the entire device unless expressly stated on the service receipt.
2. Exclusions (What Is Not Covered)
This warranty does NOT cover any loss, damage, defect, or failure caused by or resulting from:
- Acts of God and environmental events, including lightning strikes, storms, floods, fire, or other natural disasters.
- Electrical events, including power surges, brownouts, incorrect voltage, or faulty wiring not caused by Xpress Computer Solutions.
- Physical damage occurring after the repair, including drops, impacts, crushing, or other trauma.
- Liquid exposure occurring after the repair, including spills, immersion, condensation, or corrosion.
- Unauthorized repairs or modifications, including tampering, attempted self-repair, or service by third parties.
- Software, data, or operating system issues, including data loss, corruption, malware, viruses, or user-installed software problems unless directly and solely caused by our repair.
- Improper use or installation, use with incompatible accessories, or operation outside recommended environmental or electrical conditions.
- Normal wear and tear or consumable items such as batteries unless specifically replaced by us and listed on the receipt.
- Pre-existing conditions or damage not caused by our repair work.
- Cosmetic damage such as scratches, dents, or finish wear unless directly caused by our repair and documented at pickup.
3. Claim Procedure and Customer Obligations
- Notify Xpress Computer Solutions within 30 days of discovering the alleged defect.
- Present the device and the original service receipt or proof of service at an Xpress Computer Solutions location or follow instructions provided by our support team for remote or on-site follow up.
- Cooperate with inspection and diagnostic procedures requested by Xpress Computer Solutions.
- Customers must back up all data and remove personal information before submitting a device for warranty evaluation; Xpress Computer Solutions is not responsible for data loss.
- If inspection confirms a covered defect, Xpress Computer Solutions will, at its option, repair or replace the affected part or refund the original repair charge for that part and labor. If the defect is not covered, we will provide an estimate and obtain authorization before performing additional work.
4. Remedies; Limitations of Liability; Exclusive Remedy
- The remedies provided under this warranty are the customer's sole and exclusive remedies and Xpress Computer Solutions' entire liability for breach of this warranty.
- To the maximum extent permitted by law, Xpress Computer Solutions' aggregate liability for any claim arising out of or relating to the repair or this warranty shall be limited to the amount actually paid by the customer for the specific repair or service that is the subject of the claim.
- This limitation does NOT apply to liability resulting from fraud, willful misconduct, or gross negligence.
- To the extent permitted by law, Xpress Computer Solutions is not liable for indirect, incidental, special, punitive, exemplary, or consequential damages including but not limited to loss of data, loss of business, lost profits, downtime, or business interruption.
5. Conspicuous Disclaimer of Implied Warranties
TO THE EXTENT PERMITTED BY OKLAHOMA LAW, XPRESS COMPUTER SOLUTIONS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE. Where such disclaimers are not permitted by applicable law, any implied warranties are limited in duration to the duration of this express limited warranty.
6. Time to Bring Suit / Statute of Limitations
Any action arising out of or relating to this warranty or the repair must be commenced within the time period allowed by applicable Oklahoma law. For clarity, and to the extent applicable, this generally means within five (5) years for written contract claims under Oklahoma law unless a different statutory period applies.
7. Arbitration; Small Claims; Governing Law; Venue
- Customers may pursue claims in small claims court where permitted by law without first using arbitration.
- Except for small claims or where prohibited by law, disputes may be resolved by binding arbitration under rules agreed at the time of dispute; arbitration terms, if any, will be provided separately and must comply with applicable statutes.
- This warranty is governed by the laws of the State of Oklahoma without regard to conflict of law principles. Any court action not subject to arbitration or small claims procedures shall be brought in the state or federal courts located in Tulsa County, Oklahoma.
8. General Provisions
- Transferability. This warranty is transferable to a subsequent owner only if the device retains the same serial number and the original service receipt is provided; transfer may be subject to a fee.
- Parts. Replaced parts may be new or refurbished and may include third-party parts. Replaced parts become the property of Xpress Computer Solutions unless otherwise required by law.
- Modification. No employee, agent, or representative may modify this warranty except by a written instrument signed by an authorized officer of Xpress Computer Solutions.
- Severability. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Critical Data Warning
Back up your data before requesting any service. Data loss is a risk inherent to computer repair.
1. Customer Backup Obligation
You are solely responsible for creating and verifying a complete backup of all data, files, accounts, passwords, and settings before submitting any device for service. Data loss is an inherent risk of repair and diagnostic work. Do not rely on Xpress Computer Solutions to preserve or protect your data.
2. Data Recovery and Backup Services (Best-Effort)
If you request that Xpress Computer Solutions attempt to back up or recover data, we will perform a best-effort attempt using commercially reasonable methods. You acknowledge that backup or recovery of data from failing, physically damaged, or corrupted storage devices cannot be guaranteed. Attempted recovery may further degrade a failing device. Xpress Computer Solutions does not guarantee successful backup or recovery.
3. Limitation of Liability for Data Loss
Except as required by applicable law, Xpress Computer Solutions shall NOT be liable for any loss, corruption, or disclosure of data, programs, or user content that may occur during service, diagnostics, repair, testing, transport, or storage. This limitation does not apply to liability arising from Xpress Computer Solutions' proven fraud, willful misconduct, or gross negligence.
4. Repair Risks and Acknowledgment of Hazards
Electronic repairs and diagnostics involve risks. By authorizing service you acknowledge and accept that:
- Opening or servicing a device may cause cosmetic or structural damage.
- Repairs may reveal pre-existing damage.
- Certain repairs, particularly board-level work on devices with prior liquid exposure, may result in the device failing to power on or otherwise becoming inoperable.
You authorize Xpress Computer Solutions to proceed with repairs despite these risks.
5. Abandonment, Storage Fees, and Disposition
If you fail to collect your device within 30 days after we notify you that service is complete, or within 30 days after our last documented attempt to contact you, the device will be considered abandoned. We will make reasonable, documented attempts to contact you before treating a device as abandoned. If the device is deemed abandoned, Xpress Computer Solutions may charge and collect reasonable storage fees and may dispose of, recycle, or sell the device or its components to recoup unpaid service and storage costs. Proceeds, if any, will be handled in accordance with applicable law.
6. Manufacturer Warranties and Warranty Seals
Servicing your device may void the manufacturer's warranty. Xpress Computer Solutions is not an authorized service provider for all manufacturers and is not responsible for any manufacturer warranty that is voided by third-party service. If you wish to preserve a manufacturer warranty, confirm manufacturer authorization requirements before authorizing third-party repairs.
7. Customer Notice
By proceeding with service, you acknowledge that you have been advised to back up your data and that you accept the risks described above. For repairs where data retention is critical, obtain a verified backup prior to service and retain proof of that backup.
